BENGALURU: Low pickup and persistent engine sound after software application and hardware updation in his car triggered a Bengaluruean to sue an auto major for service shortage.
A city consumer online forum just recently bought the business to pay him a settlement of Rs 20,000 for inferior service and repair his cars and truck without cost.Dinesh Kumar PP, a 35-year-old homeowner of Mylasandra Road, purchased a Volkswagen Vento 1.5 Diesel Highline M7 in October 2015 and started using it routinely.
In October 2016, Skoda Auto Volkswagen India Private Limited called all its lorry owners to update their software application and hardware as per emission guidelines.
Kumar turned over his cars and truck to Elite Motors Pvt.
Ltd, an authorised dealership and service station of Skoda Auto Volkswagen at Singasandra, Hosur Main Road. The Bengalurean received the car after the said software application and extra parts update on October 28, 2016 and started driving the Vento.
He realised that its pickup had minimized significantly and there was an uncommon engine noise.
He approached the filling station with a problem however multiple efforts by technicians failed to repair the issue.
Worried that a vehicle which was working fine for a year started to provide problem after a mere emission upgrade, Kumar attempted to address the problem with the maker, just to be turned away numerous times.
He sent out a legal notification on December 3, 2016 to Skoda Auto Volkswagen India Private Limited and Elite Motors but stopped working to receive any response.
Kumar then approached the Bangalore 3rd additional urban consumer disputes redressal commission in Shantinagar in February 2017, suing the cars and truck maker for service deficiency.Kumar provided his case through his attorney, while attorneys of the opposite party said it was a false, pointless and vexatious grievance submitted with an objective to harass an internationally reputed automobile manufacturer.
The lawyers even more stated Kumars car was taken care of and repaired on several events, however his claim of a software/hardware upgrade as part of emission standards affecting the pickup and causing the engine sound was fictitious. After hearing both sides for nearly 6 years, judges of the consumer court pronounced their verdict on January 20, 2023.
They noted Kumar had not produced enough evidence like a professional report to back his claim, however several services at the filling station had actually failed to fix the customers vehicle.
This indeed amounts to service deficiency, the judges added. The court ruled that Skoda Auto Volkswagen India Private Limited and its Bengaluru service station must rectify the defects complimentary of cost.
The opposite celebrations were held responsible to pay a sum of Rs 10,000 to Kumar for the mental agony and hassle caused and an extra Rs 10,000 towards his court costs.
The amount must be paid within 30 days of the order, otherwise the opposite celebrations shall bring in a fine, the court ordered.
